Prior to the passing of the Local Government (Town and Country Planning) Amendment Act 1945, local Councils had limited control over development in their areas. This Act required anyone wanting to develop a site or property to submit an application to Council for approval. The Act defined "development" as the "erection of any building, the subdivision of the land and the carrying out of any work thereon for a purpose which is different from the purpose for which the land or building or work was last being used". The 1945 Act set up a body called the Cumberland County Council, and required it to prepare a planning scheme for the County of Cumberland, of which Sydney City Council was the Number 1 electorate. Any schemes prepared had to be approved by the Minister for Local Government. The planning schemes were colour-coded maps showing what sort of development (eg retail, commercial, light industrial, residential) would be allowed in each Council's boundaries. The City Planning and Improvements Committee and the City Engineer (who had the prescribed qualifications), prepared a planning scheme map for Sydney City Council and submitted it to the Minister for approval. The Minister amended the scheme (despite Council's objections) and it was gazetted on 27 June 1951. It was called the Cumberland County Council Planning Scheme and a copy of it is contained in this series (item 9). This Planning Scheme zoned most of Sydney City Council's area as Business and Commercial, which meant the only types of development prohibited were of offensive or hazardous industries, minor extraction industries, generating works and gas holders. The Scheme was meant to provide elementary procedures for control of development until more detailed schemes were prepared. The Cumberland County Council scheme controlled development in the City until it was replaced by the City of Sydney Planning Scheme in 1971. The County of Cumberland Council was replaced by the statutory body of the State Planning Authority in 1963. This series also contains the draft schemes prepared by Council.
