(Note: To City Building Surveyor: HJD;13/6/94. From the papers sent me herein it appears that these buildings have been erected since the passing of the City of Sydney Improvement Act; that the land to which they have a frontage is a court; and that such court is less than 20 feet in width. I am of opinion that section 15 of the said Act read with section 16 and the Schedules makes it clear that the Council cannot grant the permission asked for. The object of the Act appears to me to be to prevent that being done which in this case the Council is asked to consent to: GCW;5/9/94. This is an application to convert these Workshops into Dwelling Houses, the premises facing a court less than 20 feet wide. In my opinion this would be in direct contravention of clause No 15 of the City of Sydney Improvement Act. The matter, however, I think ought to be referred to the City Solicitor for his opinion, as I understand that it has already been brought under his notice: GMcR; 4/10/94.
