The series is controlled by:
- Resumption Claims Register (AS-0428) in the period 26/04/1906 to 24/10/1984, and
- Resumption Claim Packet Cards (AS-0064) in the period 26/04/1906 to 07/09/1984.
The packets were created by the:
- Administration Department (AG-0003) in the period 01/01/1971 to 15/03/1985, and
- Town Clerk’s Department (AG-0040) in the period 26/04/1906 to 31/12/1970.
Council was first empowered to resume land for purposes connected with streets and public places under the Sydney Corporation Amendment Act 1900, ss26-28. However, the cards in this series relate to resumptions made under the Sydney Corporation Amendment Act 1905, Part II, which gave Council additional powers to resume land for slum clearance and public housing purposes.
The first resumptions by the Council after the 1905 Act were at Athlone Place (Ultimo), and Wexford St (Haymarket). The first claim was by John J Watson and others on 26 April 1906 (CN 301). Others followed, mainly in Camperdown, Surry Hills and the Haymarket. Council's major resumptions were slum clearance operations. Land was cleared by the demolition of existing buildings, and sometimes streets disappeared or were realigned in whole or part as a result.
The packets contain claims for resumptions outside the boundaries of the Council, for electric substations and cable routes during the period before 1936 when the City functioned as Sydney's principal electricity generator and distributor. Some of these claims, from the Botany area, relate to Chinese market gardens.
The packets generally include a Notice of Claim and Abstract under the Sydney Corporation Act 1905 which contains the following information: names and descriptions of parties making the claim; situation and description of the property; quit rents payable; names of occupiers; particulars of claim, specifying the amount claimed; dates and other particulars of documents of title; names of persons in custody of the documents; signature and address of claimant and date.
They also include any correspondence between Council and the claimant, correspondence between Council and the City Solicitor; reports from the City Surveyor; reports from land valuers; notices of valuation; releases of claim, and sketch plans of the site. Once the claim was settled, Council acquired the certificates of title, mortgages, and other legal documents. It is not known how early these documents are but some at least date back to 1844, if not earlier. These were placed in an envelope inside the resumption claim packet.
The cover of the packet records the claim number (CN), the name of the resumption, and the name of the claimant.
The claims are not in chronological order. The earliest claim is numbered CN 301, which was lodged on 26 April 1906, whereas CN 1 is dated 4 October 1911 and relates to the Parramatta Road No 2 Resumption claim by Mrs Kitty Younger. The more recent claims relate to resumptions for road widening and realignment and the building of service roads. There are 2022 claim packets, the last one lodged on 24 October 1984 and settled on 15 March 1985.
