This Act required anyone wanting to develop a site or property to submit an application to Council for approval.

The Act defined "development" as the "erection of any building, the subdivision of the land and the carrying out of any work thereon for a purpose which is different from the purpose for which the land or building or work was last being used".

The Act set up a body called the Cumberland County Council, and required it to prepare a planning scheme for the County of Cumberland, of which Sydney City Council was the Number 1 electorate. Any schemes prepared had to be approved by the Minister for Local Government. The planning schemes were colour-coded maps showing what sort of development (eg retail, commercial, light industrial, residential) would be allowed in each Council's boundaries.

The City Planning and Improvements Committee and the City Engineer (who had the prescribed qualifications), prepared a planning scheme map for Sydney City Council and submitted it to the Minister for approval. The Minister amended the scheme (despite Council's objections) and it was gazetted on 27 June 1951. It was called the Cumberland County Council Planning Scheme and a copy of it is contained in CRS 437.

This Planning Scheme zoned most of Sydney City Council's area as Business and Commercial, which meant the only types of development prohibited were of offensive or hazardous industries, minor extraction industries, generating works and gas holders.

The Scheme was meant to provide elementary procedures for control of development until more detailed schemes were prepared. There were provisions for the preparation of more detailed planning schemes in the Local Government Act 1919, but Councils were not actually required to prepare schemes until the passing of the Local Government (Areas) Act, 1948-1951. This Act required local councils, including the Sydney City Council, to prepare and submit to the responsible NSW State Government Minister, schemes that would control development in their area.

The City Planning and Improvements Committee and the City Engineer were appointed by Council on 15 December 1947 to prepare a more detailed planning scheme for the City. This scheme came to be known as the City of Sydney Planning Scheme.

The Scheme was adopted by Council on the 15 December 1958 and submitted to the Minister for Local Government. It was altered by the Minister on the advice of the State Planning Authority and exhibited on 31 December 1964. (The State Planning Authority had succeeded the Cumberland County Council in 1963).

Council lodged 73 objections to these alterations and an enquiry was held, with the State Planning Authority's solicitor, Mr A I Davies, as Commissioner. The bases of Council's objections to the Scheme was that it zoned the Central Business District, East Sydney, most of Surry Hills, and all of Pyrmont, Ultimo and Chippendale as "County Centre", within which virtually any use was permissible. Council wanted restrictions on the areas in which office buildings and industries were allowed, especially in residential areas such as Surry Hills, Ultimo and Chippendale. It wanted these areas zoned residential.

The Scheme was re-exhibited on 21 November 1967 and Council again raised objections to it. It was finally gazetted on 16 July 1971.
