Report into alleged encroachment in Goulburn Street, 1834-1847

The obstruction alleged was caused by a fence erected by Henry Macdermott who claimed the land by deed. Committee found the encroachment was on land dedicated by WC Wentworth for public use on 8 August 1835 with his sale of the land adjoining it (up to McDonald's allotment). Wentworth stated his understanding at the time and since was that it would become part of the continuation of Goulburn Street. The land had since then been used as a public thoroughfare and had been improved at City expense. Committee believed that the following owners and occupiers also encroached on Goulburn Street: No 1- owner Executors of Smith, occupier James Terry; No 2 - owner William Moir, occupier A. S. Lambert; No 3 - owner Thomas Woolley, occupier Captain Fox; No 4 - triangular piece - WC Wentworth, unoccupied.
