City Surveyor, William Moir, had certified that work had been satisfactorily performed and the City Treasurer had made payments to Dingwall. The Committee reported that the City Surveyor's evidence showed he had not inspected all the work and seemed to have mistaken the meaning of the specification for the work. Measurements of work made by his assistant Mr Sheilds in company with the Overseer McBeath did not agree with Thomase given by the City Surveyor. The opinion of the City Solicitor was that in view of the certificates issued by the City Surveyor any liability of Dingwall for not completing the work as in the contract would probably not be proven in law. The Committee sought an independent report from Mr Francis Clarke, architect and surveyor, who stated that the work was not to contract with both materials and labour being inferior by a value of 25%. The Committee also observed that if authority for payments had been sought from the Committee in the first place, as had been the practice with similar contracts, that payment would not have been made. Appended: copies of 3 warrants to the Treasurer for payments to Dingwall; copies of 3 certificates by City Surveyor; specification for the work by the City Surveyor, Moir; letter from the City Solicitor, George R.
