(Note: Seymour. With reference to Mr Macpherson's letter dated 22 Instant, I have the honor to report that the drain of which he complains carries the drainage of a great portion of the south-east quarter of Surry Hills -- I inspected the place in company with the City Health Officer on Monday last, and find that on the north side of the premises a weir has been constructed of large branches of trees which prevents a free flow along the drain, while on the south side there is a flood gate which is constantly closed except on occasions of heavy falls of rain. - If it were not for these obstructions the drain would flush itself into the open drain in Dowling Street and thus the nuisance complained of might be very easily obviated - I believe that the quantity of muck and filth in Arthur Street is caused by the stoppage of this drain which otherwise would be carried down it: RS; 27/1/75. 4/2/75 refer'd to THB: BP. Memo on the matter of the obstruction in, and the cleansing of the watercourse between Arthur & Cleveland Streets -- As this watercourse is the only outlet for the drainage of this portion of the City lying between the Randwick Road, Botany Street, Albion St, Crown St, Arthur & Bourke Streets, comprising about 100 acres, it is a matter of very great importance that no person be allowed to obstruct the natural flow of the stream as in consequence damage may result to the properties in the lower part of the watershed and the health of the citizens in the locality be imperilled: To obviate the nuisance and prevent any dramage arising from these obstructions I would most respectfully suggest that the City Solicitor be consulted as to what course shall be adopted to carry out the provisions of the 13th section of the Police Act 4th William IV No.6 which enacts: "That any person who shall cast filth or rubbish into any watercourse, sewer, or canal or shall obstruct or divert from its channel, any public sewer or watercourse, within the said town, shall forfeit a sum not exceeding five pounds, nor less than one pound, and shall pay the cost of removing such filth or obstruction, or of restoring such watercourse or canal to its proper channel". I would also respectfully suggest that as soon as the obstructions are removed, that the creek or watercourse be cleaned of the filth which has accumulated in it: THB;10/2/75. 25/2/75 referred to the City Solr - for report. City Sol. to be informed that City money has been expended on it: BP. The City Solicitor would like to know when the weir mentioned in the report of Mr Seymour was erected: RD 2/5/75.
