Richard Driver, City Solicitor, informing the Council that the application of Mr Charles Laurence for a Writ of Prohibition against the order or conviction of Messrs Birrell & Peden made on 21st October 1862 upon an information exhibited by the City Surveyor for a breach of the building Act - the Supreme Court has decided that the Magistrates have no jurisdiction. He strongly recommends that an application be immediately made to the Government to amend the 3rd section of the 9th Victoria No.5 giving the Magistrates power to hear and determine all cases under the Building Acts.
