Case for opinion outlines history of Bettington St, the retaining wall and the building (a store, possibly built by the late R Towns in 1836) on land currently held by Smith and ownership of land used for earlier street widening. The street has been kerbed, guttered, partly filled and asphalted (detailed history given); the store collapsed and the street suffered a washaway (causing an "excavation") in the storm of 26 September 1895; other buildings are threatened and a retaining wall is necessary.
