By-Laws Committee
Unique IDAG-0113DescriptionThis Committee was responsible for recommending to Council all necessary by-laws for the management of Council's business, and supervising bills to be laid before Parliament. This included the markets and sale-yards, the conduct of Council meetings, (including ruling on the Mayor's robes), regulation of hackney carriages, omnibuses, and drays plying for trade in the City, issuing of licenses for public vehicles, hawkers and porters, suppressing and preventing nuisances, public bathing and reckless driving, and "boiling down" establishments.
For the year ending October 1852 it was known as the By-Laws and Market Committee, and it appears to have responsibility for supervising the markets from about 1845 when the former Market Committee ceased to function.
This Committee does not appear to have kept minutes for the period from 1843 to 1853, but presented numerous reports to Council which are contained in CRS 21.
From 1854 to 1856 when Council was replaced by City Commissioners there was no Committee structure as such in Council, but when the Commissioners were replaced by an elected Council in 1857, the By-Laws Committee was re-appointed on 27 April 1857.
The 1857 Resolution was for a Committee of Finance and By-Laws, but Finance and By-Laws seems to have operated separately except for a period from 1860-1864 when they have combined minutes.
The By-Laws Committee also took over responsibility for the issuing of hackney carriage licenses from CA 131, Hackney Carriages Committee, which was abolished when the City Commissioners took over in 1854. In 1873 the control of vehicles was taken from Council and placed with the Board of Transit Commissioners.
The By-Laws Committee seems to have made its last report to Council on 1 August 1882, regarding by-laws for cattle sale yards. There does not appear to have been a resolution of Council abolishing the By-Laws Committee but during the late 1880's, until 1898, Council appears to have had only two Committees, Finance and Lighting. The Finance Committee, which was a committee of the whole Council, appointed a number of sub-committees during these years that dealt with matters formerly considered by the By-Laws Committee, such as the Markets Sub-Committee, appointed 24 March 1891, and the Height of Buildings Sub-Committee, appointed 9 June 1891.On 22 December 1898 Council resolved to abolish the Finance Committee of the whole Council and replace it with CA 123, General Purposes Committee.
On 8 November 1898 Council resolved to appoint a Committee "to thoroughly revise the Municipal By-Laws, and report to Council". This Committee, known as the By-Laws Revision Committee was elected on 22 December 1898. On 13 December 1900 Council resolved to form a permanent committee called the Parliamentary and By-Laws Committee.
