Building and Development Plans, 1997 - ongoing

Unique IDAS-0995Date1997 - ongoingDate qualifiercircaFormatPlanDescriptionFrom 1 July 1998, the Environmental Planning and Assessment (Amendment) Act 1997 took effect, altering (among other things) the requirements and processes for lodging building and development applications with local government authorities. The Acts amended were the EP&A Act 1979 and the Local Government Act 1993.

The Council introduced a new sequence of file and plan control numbers from mid 1997 in advance of the new Act, and this record series is therefore deemed to commence from the new filing system rather than from the commencement of the Act. There are a few records in this series from 1995-1996 also.

The previous application categories 'building application' (BA) and 'development application' (DA) were replaced with requirements for (1) 'development consent' and (2) 'construction certificate'. The concept of 'integrated development' was also introduced, so that separate applications to different approval authorities are amalgamated into a single application, and the multiple approvals are coordinated by the local government authority.

Provision was made for applicants to seek certification (construction certificates and complying development certificates) from approved independent certifiers other than the relevant local government authority, and for a local government authority to set up in business as a certifier and seek business from within it's own area and the areas of other local governments.

(1) Development consent:

Most 'development' (use of land or premises, change of use of a building, advertising signage, subdivision of land, erection of a building, carrying out of a work, and demolition of a building) now required 'development consent'.

Categories of development exempt from this process were:
'Exempt development' - minor development that did not require consent.
'Local development' - development requiring consent under a planning instrument applicable to the City of Sydney, and not either 'exempt' or 'State significant' development.
'Complying development' - a subset of local development required a 'complying development certificate' instead, issued by a local government or an accredited certifier.
'State significant development' - the Minister for Urban Affairs is the consent authority.

Applications for development consent continued to be called 'development applications (DA) under the new legislative regime.

(2) Construction certificate

A construction certificate was required before commencing any building/construction work that had been granted development consent, except where a complying development certificate was in place. The construction certificate certified that: plans and specifications met applicable requirements and were consistent with the development consent; all contributions and charges had been paid; and all development consent conditions had been complied with.

This record series holds all plans submitted to the Council as part of the above business processes.

Application types (and therefore plan types) under the new regime are listed below. These are City of Sydney application categories, rather than strict reflections of the new legislation.

B - Approval applications
C - Construction certificates
D - Development consent applications
E - Commercial building certification jobs undertaken by the Council
J - Joint development application/building applications
M - Development plan applications
O - Other applications
PC - Privately certified, construction certificate
PD - Privately certified, occupation certificate
PQ - Privately certified, complying development
QA - Complying development, alterations and additions
QC - Complying development, change of use
QE - Complying development, site works
QF - Complying development, shop fitout
QP - Complying development, partitions
QS - Complying development, sign
QX - Complying development, miscellaneous
U - Subdivisions of land
XX - Extended development consent

All these alpha-suffixes denoting types of plans are followed by an annual single number identification code (for example: 1997/0001, 1997/0002 etc) except the E sequence which uses a sequential single number designation (E00001, E00002 etc).
