The Town Clerk's department had mistaken the date of the expiration of the lease and Messrs Brown & Son had continued in occupancy beyond the contract date and had claimed that payments made and accepted after that date had the effect of creating a yearly tenancy. The City Solicitor had sought counsel's opinion from Sir WM Manning and Council had served notice on Brown & Son to quit. Fitzhardinge & Son, lawyers for Brown & Son, made a proposal which the Committee recommended be accepted. The Committee further recommended that the Market Wharf be leased for a term of seven years from 1 July with certain conditions.
