Terms of the arrangement included rebuilding by Council of the walls of Talbot & Son's Stores in Macquarie Street and repair of all damage caused by the filling up of Macquarie Street, rebuilding of their vault, payment of £250 to Talbot & Son, erection of steps with Talbot's consent in the reserved passage from Circular Quay to Macquarie St with free public access to the space under the steps and no interference with the entrance to the vault, permission for Talbot & Son to have exclusive use of the excavation under Macquarie Street, and payment of all costs, in consideration of which Talbot & Son would withdraw the record in this action and abandon it. Council rejected the agreement. Appended: Memo from Rd Driver, City Solicitor, with copy of terms of settlement originally signed by Driver and Staunton Spain, attorney for Talbot & Son, recommending its acceptance.
