(Note: 3/5/75 The City Sol. to report: BP. I have examined the state of the drain at the foot of Pottinger St and the alleged silting up at that place. Our Inspector of Sewers informed me he can see little or no difference in the position of the pipes for the last seven years - The area drained by these pipes is only about 4¼ acres, and the length of streets about 575 yards. So that the silting up from this small area must by very trifling. Apart from this I am of opinion the Council are not in any way liable for the silting up of the Harbour as it is something entirely beyond their control in the existing state of the gutters and sewers. This is however a question for the City Solicitors opinion: FB; 3/6/75. The question is one of very considerable importance and in my opinion should be submitted to Council. I am however of the opinion that if the sewers and drains formed by the Council have been properly and efficiently formed then the Council are not liable to any claim for compensation such as is now made: RD; 7/6/75. 10/6/75 Mr Bell to further report on this matter: JM; 10/6/75.
