(Note: see 1802/87. The Finance Committee decided that this wall should be viewed by the Aldermen, will the Mayor appoint a time for the visit: HJD. According to your instructions I have the honor to report that the retaining wall proposed to be erected in Macquarie Street near Gipps Street was ordered by His Worship the Mayor in view of the statements embodied in an application by Mr M. Healey The circumstances are as follows:- The applicant owns land having a frontage to Macquarie Street the same has been filled in to the level of said street causing on the property a steep gradient from back to front. The street has been aligned with an eight (8) feet footway and the line to which it is suggested (by the applicant) to build the wall will leave a footway with an average width of nine (9') feet 1" thereby the wall would be off the street to the extent of one (1) foot one (1") inch. Mr Healey expresses his intention of excavating the yard so that an easy gradient may be obtained and further desires that the Council avail themselves of the extra width of footing, understanding however that he will claim no right to use the wall for any purpose whatsoever. The Papers have been forwarded to the City Solicitor to prepare a bond so that the rights of the Corporation will be preserved.
