(Note: City Engineer: CHW. There was no bursting of a sewer on Blackwattle Swamp, the inundation was due to an unprecedented fall of rain. Moreover these properties are submerged by every heavy rain, and therefore in my opinion this Council is in no way responsible for the destruction of goods so unnecessarily exposed to risk that recurs at every rain storm. As the damage was caused by surface water I would refer the matter to the City Surveyor: JTJ; 1/6/82. I concur in the opinion expressed by the City Engineer. If such claims be acknowledged, it is competent for any person to claim damage against the Council, by purposely storing valuable property on low-lying ground liable to covered by flood waters: ACM; 1/6/82. 1/6/82 City Solicitor for report: JohnH. This matter has been allowed by Mr Campbell to remain in abeyance pending the result of Mr Low's case against the Council & as the verdict in that case was such a decided one I do not think that Mr Campbell will be so venturesome as to press his claim - should he do so I advise the Council not to entertain it in any way: GM; 18 Sept 82) LanguageEnglish (eng)Digitised recordYes
