Unique IDA-00503108SeriesCity Solicitor's LettersDate16th November 1844FormatVolume - Leather BoundDescriptionMemo from City Solicitor to Buchanan, City Surveyor, in response to his memos relating to dangerous buildings and stating that he does not believe that the clause in the Police Act authorizing the removal of certain nuisances could be extended to the demolition of the dangerous buildings. In his opinion, section 63 of the Building Act which was intended to permit such action is so defectively drawn that it cannot be used, requiring a presentment by a Grand Jury which cannot be done in the Colony as the law now stands. The only action which might succeed is to proceed citing a nuisance at Common Law which would need a very strong case for conviction.LanguageEnglish (eng)Digitised recordNo
