Unique IDA-00503228SeriesCity Solicitor's Letters, circa 1843-1853Date12th September 1851Date qualifierexactFormatVolume - Leather BoundDescriptionMemo from City Solicitor: Memo from GR Nichols to the Town Clerk explaining why the prosecution of Mr Slattery for defalcations in the payment of money received by him was not followed up in the last Quarter Sessions. Slattery was charged with embezzlement and with obtaining money under false pretences. Counsel for the prosecution, Mr Foster, advised that the first charge could not be sustained and it was withdrawn leaving the second charge to proceed. As that charge was only a misdemeanour, the defendant had certain rights which when exercised caused the matter to be held over to the next sitting of the Criminal Court. Appended: Opinion by W Foster, 366 Castlereagh St to proceed with charge of obtaining money under false pretences as the charge of embezzlement would not succeed if Slattery had not been given the authority to collect the money; further that the charge in relation to failure to account for money received from Soper could also not be sustained.LanguageEnglish (eng)Digitised recordNoBorn digital itemNo
