In the first case, the City Rates Act exempts the owner from payment if the building has been vacant for the whole of the period rated; in the case of a tenant assessed for a period when he was not in occupation he is entitled to deduct that amount from his rent; neither the owner nor a subsequent tenant can be rated for premises vacant for the whole of the period rated; accordingly in the case of Mr Kettle's house no demand for payment can be made. In the second case, in relation to certain premises vacant for less than the rating period where insufficient distress was found, the proprietor or landlord is liable. In the third case, where no distress warrant has been executed, the Mayor may proceed in that way; the issue of a previous warrant does not preclude issuing another. In the case that the full facts have not been received, this advice can be amended. Appended: Distress Warrant issued to John Gardner Austin and assistant Lawrence Gaffney to proceed against John J Kettle, owner of premises in Druitt Street, for the recovery of City and Police Rates for the half year ending 31 December 1844 "by distress and sale of goods" at the premises; signed by George Allen, Mayor and affixed with the Seal of the City of Sydney. Annotations on reverse by John G Austin relating to the rating history of the premises owned by Kettle and later occupied by Magner & Cashman with details of occupancy and of issue of a duplicate distress warrant.LanguageEnglish (eng)Digitised recordNo
