(Note: Mr Mountain. Lane between Ridge & Cleveland Sts. There is undoubtedly likely to be a great nuisance arise in this, and similar lands: but I have taken trouble to enquire into this matter to ascertain the responsibilties of Council in this particular case. I found that this is on the subdivision of the "Denison Square" Estate, and is one of a series of lanes termed on the plan "Reserved for back entrances". The widest of these is only 16 feet wide. I find no dedication to the public, nor acceptance on the part of the Council; and I see nothing to prevent the proprietor of the Estate closing them to the public, if he chooses to do so. I therefore cannot consider them as public ways, and should like the C. Solicitor's opinion on the point. At the same time it seems hard that nothing can be done to prevent these narrow private lanes from being formed contrary to law: because (in self-defence) the Council is bound in time to acknowledge them and maintain them; whilst properly laid-out lanes, fulfilling all legal requirements, are formed and ballasted at the cost of the owners.
