(Note: It appears by some deeds which I saw that Mr Brigden and Mr Windon agreed to give each 10 feet towards laying out Elizabeth Street. Some time afterwards Mr Brigden put his fence into the middle of this street and assigned as his reason that it was dangerous to the public - and he only fenced it for safety - Mr Windon complained to me of this but I could render him no assistance because the street had never been dedicated to the public - Mr Brigden then came to complain of Mr Windon and I advised him to pull the fence down which he had erected in the street. It appeared he did so, but it was too late as Mr Windon commenced at the same time to resume his land - and erect a fence to his alignment - and appears determined to maintain his fence in that position. The City has never claimed the street nor made it and therefore has no cognizance of it.
