(Note: This is a long disputed a/c, and as far as I can remember, the facts are as follow - The late City Surveyor obtained a price from Mr Sutton for this work who undertook the job at 2/6d per ton. At the time Mr Sutton tendered he must have seen the state of the pitch, and should have known that it would be impossible to cart same until it was placed in tanks or some other such receptcle; when the matter was brought before the late C.S. he would not deal with the case, remarking that he could not see the justice of the claim, as the contractor knew exactly what he had to do when tendering. From Enquiries I have instituted I am of the same opinion as the late City Surveyors.
